Withdrawal, Cancellation, Rescheduling, and Cancellation by Alchemy Sound Studio
1. General Information and Statutory Right of Withdrawal
(1) The following provisions regarding withdrawal, cancellation, rescheduling, and cancellation by us apply in addition to any mandatory statutory rights, in particular any statutory right of withdrawal, where such right exists in the individual case.
(2) Consumers generally have a statutory right of withdrawal for orders of bowls and other physical goods placed via our online shop. Details are set out in our separate cancellation policy.
(3) There is no statutory right of withdrawal for bowls and other goods where the purchase contract is concluded on our business premises, unless mandatory statutory provisions provide otherwise.
(4) There is no right of withdrawal for contracts concerning the delivery of bowls that are not prefabricated and are manufactured on the basis of an individual selection or determination by the Customer, or that are clearly tailored to the Customer’s personal needs.
(5) The Customer’s statutory rights, in particular statutory rights in the event of defects, remain unaffected.
2. Events, Sound Baths, and Other Scheduled Offerings
(1) For bookings of sound baths, workshops, retreats, private sessions, and other events with a fixed date or period, a statutory right of withdrawal shall only apply where provided by law.
(2) To the extent that no statutory right of withdrawal exists, cancellation, refund, and rescheduling are excluded.
(3) Rescheduling is only possible with the express written consent of Alchemy Sound Studio and only in exceptional cases.
(4) The transfer of a booked place to another person is permitted, provided this is communicated in writing in good time before the start of the event and no important organizational reasons prevent it.
3. PR Events, Corporate Bookings, and Brand Collaborations
(1) Bookings of PR events, corporate sound baths, brand collaborations, and comparable B2B services are binding once the booking and appointment confirmation have been made.
(2) A cancellation free of charge is only possible up to 30 calendar days before the agreed date.
(3) In the event of cancellation less than 30 calendar days before the agreed date, Alchemy Sound Studio shall be entitled to charge the agreed fee in full, unless expressly agreed otherwise in writing in the individual case.
(4) The right of both parties to terminate for good cause remains unaffected.
4. Trainings and In-Person Programs
(1) Bookings for trainings, certification programs, and comparable in-person formats are binding. A statutory right of withdrawal shall only apply where provided by law.
(2) To the extent that no statutory right of withdrawal exists, a refund of the amount paid is excluded.
(3) If participation on the booked date is not possible, rescheduling to a future date or another training unit may be requested in writing, subject to availability.
(4) A rescheduling fee of 20% of the originally booked price may be charged for an approved rescheduling.
(5) There is no entitlement to rescheduling.
5. Online Trainings and Digital Content
(1) For online trainings, on-demand courses, and other digital content not supplied on a tangible medium, a statutory right of withdrawal shall only apply where provided by law.
(2) The right of withdrawal expires prematurely if Alchemy Sound Studio has begun performance of the contract after the consumer
a) has expressly consented to Alchemy Sound Studio beginning performance before the withdrawal period has expired, and
b) has confirmed that they are aware that by giving such consent, they lose their right of withdrawal once performance begins.
(3) Upon purchase and activation of an online training or digital content, the Customer receives immediate access to the booked content.
(4) Once access has been granted and, where legally effective, the right of withdrawal has expired prematurely, cancellation and refund are excluded.
6. Other Services
(1) For services that are neither digital content nor scheduled leisure services, the statutory provisions shall apply.
(2) The right of withdrawal expires prematurely if Alchemy Sound Studio has fully performed the service after the consumer
a) has expressly consented to Alchemy Sound Studio beginning performance before the withdrawal period has expired, and
b) has confirmed that they are aware that they lose their right of withdrawal upon full performance of the contract.
7. Cancellation or Changes by Alchemy Sound Studio
(1) If an event, training, PR appointment, or other service must be cancelled or postponed by Alchemy Sound Studio for an important reason, in particular due to illness, force majeure, or other unforeseeable circumstances, Alchemy Sound Studio shall, at its discretion, either
a) offer a replacement date, or
b) refund in full any amount already paid.
(2) Any further claims by the Customer are excluded unless mandatory statutory provisions provide otherwise.
(3) Changes to the schedule, program, teachers, or event location remain reserved, provided such changes are reasonable for the Customer taking into account the interests of Alchemy Sound Studio.
8. General Payment and Organizational Information
(1) Unless otherwise agreed, invoices are payable within 7 days of receipt of the invoice.
(2) Any fees incurred due to chargebacks or failed payment attempts caused by the Customer and not attributable to Alchemy Sound Studio shall be borne by the Customer, to the extent permitted by law.
(3) Costs for travel, flights, accommodation, or other third-party services will not be reimbursed by Alchemy Sound Studio unless mandatory statutory provisions provide otherwise.
(4) Alchemy Sound Studio accepts no liability for delays or cancellations of means of transport such as flights, trains, buses, or other transport services, unless mandatory statutory provisions provide otherwise.
(5) No liability is accepted for loss, theft, or damage to participants’ personal belongings, unless mandatory statutory provisions provide otherwise.
(6) We recommend that all participants, especially when making travel arrangements, take out suitable travel, cancellation, and health insurance.
